Terms of Service

1. Agreement to Terms

By accessing or using GetCitedBy ("Service"), operated by GetCitedBy Ltd ("Company", "we", "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

GetCitedBy is a SaaS platform that provides AI visibility auditing, monitoring, and optimization services. The Service analyzes how brands appear across AI-powered answer engines (including ChatGPT, Claude, Gemini, and Perplexity) and provides reports, scoring, content recommendations, and optimization tools.

3. Account Registration

To access paid features, you must create an account with a valid email address and password. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must notify us immediately of any unauthorized use.

4. Subscription Plans and Billing

GetCitedBy offers subscription plans (Monitor, Optimize, Autopilot) and one-time products (Deep Audit). Subscription pricing, features, and limits are described on our Pricing page.

• Billing cycle: Subscriptions are billed monthly in advance via Stripe.
• Payment method: You must provide a valid payment method. Stripe processes and stores all payment information — we do not store card details.
• Price changes: We may change subscription pricing with 30 days' written notice. Existing subscriptions continue at the current rate until the next renewal after the notice period.
• Failed payments: If a payment fails, we will retry per Stripe's retry schedule. After repeated failures, your account may be paused or downgraded.

5. Cancellation and Refunds

• Cancellation: You may cancel your subscription at any time from your account dashboard or by emailing help@getcitedby.tech. Cancellation takes effect at the end of the current billing period — you retain access until then.
• Refund policy: All plans include a 7-day money-back guarantee from the date of initial purchase. After the 7-day period, subscription fees are non-refundable. One-time purchases (Deep Audit) are refundable within 7 days if the audit has not yet been delivered.
• No proration: We do not prorate partial months upon cancellation.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law.
• Attempt to gain unauthorized access to the Service, other accounts, or our systems.
• Reverse-engineer, decompile, or disassemble any part of the Service.
• Resell, sublicense, or redistribute access to the Service without written authorization.
• Use the Service to generate false, misleading, or deceptive content.
• Exceed reasonable usage limits or abuse API access in a way that degrades service for other users.

7. Intellectual Property

• Our IP: The Service, including its software, design, branding, methodologies, and documentation, is owned by GetCitedBy Ltd and protected by intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service.
• Your data: You retain ownership of all data you submit to the Service (company name, website URL, industry, brand information). We use your data solely to provide and improve the Service.
• Reports and deliverables: Reports, audits, scores, and content generated by the Service for your account are licensed to you for your internal business use. You may share reports with your team, stakeholders, and clients. You may not resell generated content as a standalone product.

8. AI-Generated Content

Portions of the Service use AI models to generate analysis, content, and recommendations. While we apply quality assurance processes to all deliverables, AI-generated content may contain inaccuracies. You are responsible for reviewing and verifying any content before publication. We do not guarantee specific outcomes from implementing recommendations.

9. Data Processing

We process your data as described in our Privacy Policy. By using the Service, you consent to data processing in accordance with that policy.

10. Service Availability

We aim for high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or circumstances beyond our control. We will provide reasonable notice for planned maintenance.

11. Limitation of Liability

To the maximum extent permitted by law:

• The Service is provided "as is" without warranties of any kind, express or implied.
• We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost revenue, lost data, or business interruption.
• Our total aggregate liability arising from or related to these Terms or the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.
• We are not responsible for changes in how third-party AI platforms (ChatGPT, Claude, Gemini, Perplexity) rank, cite, or present information about your brand.

12. Indemnification

You agree to indemnify and hold harmless GetCitedBy Ltd, its officers, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

13. Termination

We may suspend or terminate your access to the Service if you breach these Terms, engage in fraudulent activity, or fail to pay. Upon termination, your right to use the Service ceases immediately. We may retain your data for a reasonable period as described in our Privacy Policy.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Continued use after changes take effect constitutes acceptance of the revised Terms.

15. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
